Terms and Conditions
1. Offer
Our offer is based on the information given to us by the seller / hirer respectively third parties. We can not assume liability for correctness and completeness.
2. Transfer of information
Our offers and communication are designed for the offeree only. In case of transfer to third parties without our acceptance, the offeree has to pay the commission to us at conclusion of main agreement via the third party.
3. Precognition
Does the offeree has already knowledge about negotiability / lettability of one of our proven objects, he is bound to inform us immediately, within 8 days at the latest in writing, after confirmation of the object by Esplanade Immobilien Consulting GmbH.
4. Exercise for the other contract partner
Esplanade Real Estate Consulting is entitled to act on behalf of the other contract partner on subject to commission.
5. Commission
Unless otherwise noted in the offer,
a) the buyer pays a commission of 5 % plus VAT of the obtained contract value and of all connected ancillary services to us at conclusion of contract of purchase.
b) At conclusion of a hiring contract / lease agreement with a contract period of 10 years or more, the hirer / tenant pays a commission of 3 % based on the 10-years-gross-rent (gross-rent = net rent + operating costs) plus VAT to us. In case that the contract period is less than 10 years, but the hirer / tenant has been given an option, that allows the hirer / tenant a contract period of 10 years, - irrespective if the option is performed or not, the hirer / tenant pays a commission of 3 % based on the 10-years-gross-rent plus VAT to us.
c) At conclusion of hiring contracts / lease agreements with contract periods less then 10 years, but longer than 5 years – the hirer / tenant pays a commission of 3 % of the whole contract rent (net-rent + operating costs) plus VAT.
d) At conclusion of a hiring contract / lease agreement with a contract period up to 5 years, the hirer / tenant pays a commission of three gross monthly rents ( gross monthly rent = net-rent + operating costs) plus VAT (related to the agreed rent / in case of graduated rent based on the average rent of the fixed contract period.)
6. Alternative Business
Does an alternative business, that is virtually caused by the action of the estate agent, comes about instead of the initiated business, a commssion that is customary in place has to be paid. This particularly applies if the offered object is bought in the context of a compulsory auction at award of the appropriate County Court. The commission is furthermore due at the point when the rights are gained by the registered holder of the legal charge over the property and has to be paid to us on the date of conclusion of contract.
Is another transaction agreed, after conclusion of the original transaction, which is caused indirectly or directly by action of the estate agent, terms and conditions with the corresponding rates apply aswell.
7. Follow-Up Business
We are also entitled to commission claim in case that further contractual agreements come about in a timely and commercial connection with the first arranged, respectively proven contract.
8. Acceptation of terms and conditions
Acceptance of negotiations with our company and requests or viewings of the proven object are to be classified as acception of terms described herinbefore.
9. Venue
Venue for registered traders is Lübeck.
